The preparation and validity of pre-nuptial agreements

A pre-nuptial agreement ought to be considered when you are entering into a marriage or civil partnership, and have assets that you wish to protect in the event of your new relationship breaking down.

Pre-nuptial agreements now carry more weight than they once did, due to the developments in case law. In the event of divorce or dissolution, they are likely to be accepted by the court and thereby ensure the protection of assets acquired prior to the inception of the relationship. A prenuptial agreement may also deal with the distribution of the assets acquired during the marriage or civil partnership.

We advise both on the creation and validity of such an agreements. Additionally, we can provide expert advice and act for clients who wish to enforce any pre-nuptial agreement already in place.
